Hi, this is true in a lot of cases, however history has shown that if you are one year into your 2 year contract, they want to make that sale bad enough. So, they will usually wave the $250 extra cost and just charge you the price for the phone plus the new contract. They will do the bit about how they have to get manager approval and they will make you think it's only for you and you only, but they will do it. How do I know this? Because my wife's 2-year contract is up next March 2013, and yet she's eligible for the iPhone 5 now as well as the new Galaxy 3S. They just want to make those numbers. Now, if you had just gotten a new 2 year contract like 2 months ago or less, then yes, I think they will definitely charge you the phone cost plus $250 plus a new contract. With those prices, you might as well just purchase it unlocked and unbranded I think.

If you got your 4S on contract with AT&T last year I just heard on the Today
in iOS podcast that AT&T would charge youa $250 upgrade fee on top of the
price of whichever iPhone you pick + another $36 fee for whatever and they
will force you to extend your contract for another 2 years from now. So, if
you pick the iPhone 5 16 Gb which is $199 on contract if you are allegeable
for full subsidy, it would cost you $199 + 250 + 36 = $485. And if you
currently have a 32 Gig or 64 Gig you can add $100 or $200 respectively to
the $485. For $650 ($165 more than what you would pay for an early upgrade)
you could buy an unlocked iPhone 5 16 Gb.

Anyhow, if you have a 4S there is very little reason to upgrade, keep in
mind that on top of the upgrade price you have to get a new case or cases
because it's bigger, if you have extra cables or docks you either have to
get 30-Pin to 9-Pin adapters or buy new cables and docks. As far as I can
tell putting iOS 6 on your 4S will give you all the new features including
Panoramic photos, the new VIP email feature, the new phone features, maps
with turn-by-turn guidance, the Passbook app etc. Only thing you wouldn't
have is a physically larger phone, a 720P HD front camera and LTE support.
Well, I guess you also don't have the A6 processor and the new touch screen
which is supposed to be more precise, but let's face it, the 4S is a very
fast and snappy phone.
