If you restore your new device from a backup of your old device, the folders will indeed remain the same. I went from an iPod Touch 3rd gen to an iPod Touch 5th gen with no problem. If you have a lot of audio content on your device, just plan to be very patient and leave it alone in the restore process for as much as a few hours. If you interrupt it too soon, you will have a mess.
