Hi, The downgrade doesn't just happen, but even if we disregard this and assume you're running a 5X baseband, afaik you'll still have problems.
The latest version of iOs6 which is the only version you'll be able to upgrade to isn't jailbreakable for you. Unfortunately, since you're wanting a software unlock, the only way you will be able to unlock it is if you jailbreak. The only options I see for you is a hardware unlock or to wait until iOs7 is jailbroken, hope that the 3GS supports it and then just upgrade to that. Sorry to be the barer of bad news. Cheers, Ben.
