I checked and my serial number was accepted. There was some confusion when I brought the phone to the apple store because somewhere on their page it's indicated that phones need to have been purchased less than 2 years before but I got mine accepted. Later I double-checked with apple on the phone and they say that every phone exhibiting the lock button problem with eligible serial number will be accepted for repair. If anyone has payed for it or for a phone replacement because of this issue it's worth contacting apple. You can send the phone in by mail but I'm not sure if they would give you a loaner and that's why I chose to go to the store. Incidentally the nice thing is that they'll also replace the battery while they're at it.
