People who are suppliers to governmental or educational agencies must comply as well in the US. Whether or not general businesses must comply under the Americans with Disabilities Act is still undecided. The Department of Justice takes the position that the ADA applies to all business on the internet while some of the courts have disagreed. Others have said in cases decided on other grounds that the ADA does apply. So right now you could take either position in the US and find support for it. One of these days either Congress will clarify the law or the US Supreme Court will rule on it and then it will be settled one way or the other.
Either way I discourage the use of a twisted text image as a CAPTCHA. A better method is one that Eric Meyers has a WordPress plug in for. A simple question must be answered before the email address is displayed. Since you can use random questions it is hard for a bot to figure them out yet a screen reader has no problem reading them or a person figuring out the answer. I noticed that PayPal is using a visual CAPTCHA but has a link to an audio version of the same image for those who are visually impaired. Course I've missed some of the visual CAPTCHA because the characters were so twisted and obscured with random 'noise' or lines that even with normal vision it was impossible to tell 0 from O or even Q or 5 from S.
