Brian, There are many departments within CMS. From what I hear, the enforcement of HIPAA is in the hands of a different department than the implementation of the transactions and code sets by CMS as a covered entity. And one of the persons in charge of enforcement mentioned during a meeting on Tuesday that they have built some sort of firewall between the two. The call on Monday was with the covered entity side of CMS, not with the enforcement side.
