I do not want to beat a dead horse here, but I would argue that the situation I described in not an unsolicited 271, but rather a solicited 271 in which the method of response is different than the method of inquiry.
So are you saying that the only time a 271 or 277 would be sent is if each was preceeded by a 270 and 276, respectively? I would agree that 99% of the time the method used in the inquiry would be the same (and preferred) method used in the response. So I guess the real question is this: Does a health plan have to have the capability to respond to a non 270 or 276 inquiry (e.g., paper, phone, fax) with a HIPAA-compliant 271 or 277?
