IG Violates X12 Standard - 095 A1 X12 834

My understanding of the Implementation Guide(s) is that HIPAA rules may not violate an X12 Standard. 

    Does not the following situation violate this rule?

        The X12 MAX USE = 3, yet the IG Repeat = 4

                X12 834 Eligibility Transaction - X095A1

IMPLEMENTATION

Loop: 2300 - HEALTH COVERAGE

Usage: SITUATIONAL

Repeat: 4

130 2 Notes: 1. This data should only be transmitted when such transmission is

required under the insurance contract between the sponsor and payer.

STANDARD

Level: Detail

Position: 280

Loop: 2300

Requirement: Optional

Max Use: 3

Purpose: To indicate the total monetary amount
