The problem is the terminology used. Open access in its original meaning meant that journals were both without price barriers and without permission barriers. This is the meaning used in both the Budapest and Berlin statements.
However, some in the publishing world are using the term open access to mean only without price barriers. Some OA advocates are today distinguishing between "gratis open access" -- that without price barriers only and "libre open access" -- that with both barriers removed".
