The problem is the terminology used. Open access in its original meaning meant 
that journals were both without price barriers and without permission barriers. 
This is the meaning used in both the Budapest and Berlin statements.

However, some in the publishing world are using the term open access to mean 
only without price barriers. Some OA advocates are today distinguishing between 
"gratis open access" -- that without price barriers only and "libre open 
access" --  that with both barriers removed". (See

I think I am not mistaken in thinking that the default of anything available 
for free online that doesn't have a license or explicit terms of use is 
traditional copyright. In my view, that is the case with repositories (I am 
referring to universities or public organisms) that provide free access to 
scientific material that can be used in education, but no license or a 
statement indicating the terms of use. They are "open access", and they are 
educational resources, but reading your comments lead me to maintain that they 
are not, or the items they contain, open educational resources. They are not 
different from any other materials that we can use in education and which, 
despite being freely available online, do not state their conditions of use.

The field is evolving so fast I think these ambiguities will tend to be better 
clarified in the near future, but for now I'll stick with this belief. Not that 
it matters a lot in practical terms, but  it does when you're approaching this 
from an academic or research perspective.
