Under our core principles of
engagement<http://wikieducator.org/OER_university/Core_principles_of_engagement>
course
materials hosted on OER Foundation infrastructure to guide and support
learners must use free cultural works approved licenses (CC-BY, CC-BY-SA or
resources dedicated to the public domain). Of course, it is possible to
link to open access resources available on the internet from the centrally
hosted materials.

The default WikiEducator license is CC-BY-SA but the community also
supports the use of CC-BY. A number of OERu courses use the CC-BY license.

The reasons why we avoid the use of NC resources is pragmatic:


   1. Under Version 3.0 of the Creative Commons licenses, the copyright
   holder defines what is meant by non-commercial. The OERu partners will
   charge fees for formal assessment. Some NC copyright holders will deem fees
   charged for assessment services based on NC licensed materials as
   commercial activity, while others may be have a more lenient interpretation
   with regards to public institutions charging assessment fees.
   2. Many OERu courses are derivative works from existing resources.  When
   remixing two or more CC-BY-NC-SA resources , it would be necessary to
   confirm the copyright holder's definition of NC because the definition of
   what constitutes non-commercial may vary among NC copyright holders. The SA
   requires that the derivative work should be released under the same
   license.

Stephen is correct in highlighting the risks of enclosure where corporate
interests may restrict access to CC licensed materials by placing them
behind a pay wall or using technological means to control and restrict
access or by adding more restrictions over time. Two examples spring to
mind. Flatworld Knowledge originally used a CC-BY-NC-SA license -- over
time, these resources were enclosed by deploying technological means
increasing restrictions to access these materials. Another example is the
Kahn Academy. In the early days the Kahn Academy used the default YouTube
license. After lobbying and encouragement from the OER community, the
license was changed to a CC-BY-SA license. As funding to support the Kahn
Academy increased, a more restrictive license was applied (CC-BY-NC-SA).

Free cultural works approved licenses place an additional requirement in
using open and editable file formats to facilitate remix.
