The problem with this one is that when things get to a formal stage the 
battle has likely already been lost.  Formal dispute resolution is 
highly adversarial with the disputants willing to pull out any evidence 
that could remotely help their cause; this exacerbates the problem and 
brings attention to details that would have otherwise been dismissed as 
insignificant.

Better to find ways that bring disputants together instead of wedging 
them apart.
