You're just plain wrong.  Theft is theft.  The actual crime varies [the 
three related crimes are larceny, robbery and burglary], but it is still 
a crime. Larceny is simply taking stuff and can be a misdimeanor or a 
felony depending on the circumstances [all this is from the VA code -- 
YMMV]; robbery is taking stuff by force; burglary is taking stuff by 
breaking and entering.  The question of _civil_ liability [and whether 
you'd have trouble collecting on your insurance] is wholly irrelevant to 
the question of whether the act is illegal or not [which it is].
