How is the distinction made between netstumbling and theft of information?
Can I scan the airwaves enough to find signs that an 802.11 protocol is
used on a certain frequency, but not go so far as to look smtp traffic
being carried (assuming no encryption)?  Is data captured (ie:
copied) while sniffing the airwaves stolen?

I'm sure there's more legalese behind this, but from what you posted it
sounds like the act of listening to certain types of bits in the air is
ok, while listening to others is not.  Not that this would surprise me of
course.
