He is paying for the use of the tower/roof, and this conveys contract rights.
If he was smart, the contract would be written so that there is some
exclusivity to the service type (otherwise you'll have two of more 2.4ghz
WISPS on the same tower/roof... it has happened). However, you are correct in
that he'd have no rights over on the next tower/roof.
