You can disagree all you want, but history in telecom since 1996 proves that this strategy doesn't work.
There was a CompTel lawyer who stated that 100's of lawyers and millions of dollars working under the Regulate Them, Not Me plan DID NOT work. If it did, there would be a thriving CLEC and ISP industry today.
