I don't know why the term "ISM Band" even got created. I think it is just from the blurring of terms. ISM is a licensed service (Part 18) and it is authorized in many frequency ranges "from DC to Daylight". What we do is Part 15. So are the 49 MHz baby monitors, walkie-talkies, remote thermometers. We are the lowest form of scum on the totem pole, to put it honestly.
Sometimes I shudder to think that we base a majority of our business (and pay $5,000-$10,000 for radios to do it with) on spectrum that is basically a garbage can. This is one of the reasons why we need better/licensed spectrum that can get the job done for us and not base our living on whether or not someone else (whether it is a Ham or other licensed user) fires up alongside or next to us. This is why I "snicker" every time someone tries to brag about their "exclusive rights" to a frequency on some particular rooftop or tower or even an city. There was a large(ish) WISP owner out on some lists at one time who used to boast about his exclusive rights to use 5 GHz in a certain area, on certain rooftops, etc. I always just said "show me your license". Then he just started blabbering that he would just hit anyone who interfered with a civil suit for hurting his business. When you say "does not allow data", do you mean spread spectrum communications? For example, isn't the little slice of unlicensed spectrum at 49 MHz an ISM band?
