I am not a lawyser but my understanding is that the code *must* be released. If you use DTF *unmodified* from a WiX toolset distribution then we already distributed the code for you (it's on CodePlex). If you *modified* DTF (or other WiX toolset code) then you need to publish the modifications. Ideally, you'd do that by contributing back back to the repository on CodePlex (aka: a pull request).
