No, the software by itself is not illegal.  The software is capable of unattended operation, but it isn't illegal unless it is used in that way.

I can let someone who isn't licensed use my station while I am not even in the U.S., but neither I nor my station is performing an illegal act unless I do that.

I can own an amplifier that is capable of putting out 5,000 watts, but it isn't illegal unless I run it harder than 1,500 watts.

You really don't know what you're talking about, and it has nothing to do with me rationalizing anything.

The program is designed to make QSOs without someone being there.  Illegal in the US, the person who put the program together could have removed the code and left the UI.      He didn't, and added a 'legal notice' which is worth the paper it's not printed on.

What specific FCC regulations permit a single QSO to be auto sequenced but prohibit auto sequencing of 2 or more QSO?

I had been under the impression that disallowing auto QSO sequencing was a preference of the developers so, if it is illegal, I'd appreciate a reference.   I can legally allow an unlicensed operator to make my QSO but I can't allow a supervised computer to do it?

Before you all jump on me - I have no interest in running an automatic QSO machine.  I'm only interested in the regulatory aspect of this.
