Ok I have a solution
I just dont call
a2dDocviewGlobals->GetDocviewCommandProcessor()->FileClose();
and just call
wxASSERT(a2dDocviewGlobals->GetDocviewCommandProcessor()->CreateDocuments
(wxT("dummy"),wxDOC_NEW,
FindDocTemplate("LayerDocument")));
Well I think I don't have to bother with fileClosing it's like when I call
a2dDocviewGlobals->GetDocviewCommandProcessor()->OpenFile();
