Then I just need to know where you
think I should put the code. As I mentioned in one of those threads, the
current XNode code is at org.apache.xnode.*, not org.apache.xindice.xnode.*.
If that's not an issue, it's an easy insert. It's not within Xindice's
tree because, as I said, it's not an API necessarily specific to Xindice.

I'm fine with packaging, atm: we might discuss it later. I'd love to see it committed in our scratchpad. Are there any licensing or IP issues?

No, as I mentioned a long time ago (though I'm not expecting anyone to remember specifically), the API was developed while I was still at Sun, but it was done specifically to be donated to Apache (hence the apache package name). It currently has an Apache license. There are no issues with IP that I'm aware of.
