HIPAA, or Public Law 104-191 was enacted on August 21, 1996. That law
contains the following language:

"This section also contains
requirements concerning standard
setting.
� The Secretary may adopt a standard
developed, adopted, or modified by a
standard setting organization (that is, an
organization accredited by the American
National Standards Institute (ANSI))
that has consulted with the National
Uniform Billing Committee (NUBC), the
National Uniform Claim Committee
(NUCC), the Workgroup for Electronic
Data Interchange (WEDI), and the
American Dental Association (ADA).
� The Secretary may also adopt a
standard other than one established by
a standard setting organization, if the
different standard will reduce costs for
health care providers and health plans,
the different standard is promulgated
through negotiated rulemaking
procedures, and the Secretary consults
with each of the above-named groups."

So, since the W3C is neither an ANSI accredited standards development
organization nor one of the others, XML would not qualify for inclusion
under HIPAA. Furthermore, XML V1.0 alone is insufficient to provide the
robust data management capabilities available with the X12 syntax. Lastly,
XML is the new kid on the block and much too new to have been included in
all of the work preceding and during the rule making pursuant to PL 104-191.

The effective date of final rule is October 16, 2000 and compliance with the
final rule must be within 2 years and 60 days from the date of publication
in the Federal Register, which was August 17, 2000.

Hi Group,

I was wondering as to why , HIPAA mandates the
use of ASC X12, while the data interchange technology
seems to go the XML way. As this is a  recent
regulation , why not as well move to the contemporary
XML technology which makes it easier to integrate data
with enterpise applications.

And the other thing I would be interested to know is
the timeline of compliance.
