I don't think so. Actually the problem lies in the DocBook-XSL stylesheets:
a table of contents for an empty document results in an empty 'fo:flow'
element, which indeed doesn't conform to the XSL Recommendation. Perhaps FOP
0.92 will handle this better, but an easier workaround is to add content to
your document.
