I did not follow the nature of your argument here however cde Elias did address the issue of why the ANC leadership took Cope to court. It was not about the name 'COPE' but 'Congress of the People'.
Bear in mind that the original Congress of the People in 1955, was aimed at forging a kind of multiracial front against the 1948 accession to power of the Afrikaner Nationalist Party, with which an alliance of all components of the Congress Movement comprising of Africans (ANC), Indians (SA Indian Congress) Coloureds (Coloured People’s Congress) and
whites (Congress of Democrats), adopted the Freedom Charter.
This led to the ANC adopting this document as the cornerstone of its policies and ideals until to date. This was the cause in which the greatest racial spread of members of the Congress Alliance became aligned with the ANC as a political home to a large category of people. The ANC is the only surviving component of the Congress Movement or Congress Alliance that can claim common law rights to the heritage, identity, goodwill and history of the Congress of the People held in Kliptown.

Comrades, I think we are entangling ourselves in legal and petty arguments on the contest for hegemony within the South African society. I may not be capable of objectively analysing the political terrain currently, but I am not convinced that we are performing well under the circumstances.
Firstly, it is almost an illusion to think that legally our revolutionary argument around the congress of the people and the freedom charter will grant us sole ownership of these heritage. The struggle was not a legal case study, we need to fight for it in the hearts and minds & soul of our people. What we are currently doing is to show that we are underdogs, losing hegemony of our struggle credentials in the process.
Secondly, failing to comply with the system we created is frankly irresponsible and a sign of an administration and leadership that is not focused, or no leadership at all. How can the ANC fail to register candidates for an election? When did we start running out of comrades to deploy? I'm still to read about what the organization is doing to whoever is failing the organization. All I hear, painfully, is that we will challenge such mistakes in court. Not even members of the ANC are impressed by this ineptness, let alone those vacilating members of civil society. Surely we cannot afford to continuously portray a failing ANC.
It will be progressive to go back to basics. Work in branches, and win hegemony within the masses regardless of who calls him/herself congress or convention of the people. Let's be brutally honest to any comrade who fails the ANC, even if it is an NEC member, we cannot afford to campaign and fail in court every fortnight and still hope that our people's confidence in the ANC will remain will remain unshaken.
Dear: Comrades Am utterly dissapointed that again the courts of this country have failed to distiguish facts from opinions by ANC dissidents. Or either the legal team representing us were unable to use documented historical facts to argue that COP is part and parcel of the furniture of the ANC. I am very much worried about the weight of our argument, read both affidavits on www.thetimes.co.za for further reference. It is a well documented historical facts that COP was first mooted in the ANC circles and the 1953 CAPE Conference in Cradock adopted a Proposal to convene a convention of South Africans which was made by the late, then ANC President of CAPE Prof Zachariah Keodirelang Mathews.
