Maila >>> [email protected] 10/08/09 9:29 AM >>> FREE AT LAST Thursday, October 08, 2009 On Monday, 05 October Kaizer Mohau was found not guilty of all the charges presented before the court by the National Prosecution Authority. The charges followed an accident Kaizer Mohau was involved in, in February 2008. Mohau was charged with the following charges: 1. Culpable homicide due to the unfortunate dearth of a young boy, 2. Drunk and driving * and 3. Reckless driving. Since after the accident many in the media tried to create the impression that Mohau killed the young boy deliberately * this was shown through the manner in which the media reported on this matter. It was not only the media that played this anti * Mohau attitude, in fact some of our cadres in both the ANC and the City council played this role including to use the media in ensuring that Mohau's being is compromised. For starters it is a proved fact that some ANC Comrades leaked the wrong information to a certain SABC radio station * in which they claimed Mohau did not have a drivers license. The media did not even try to verify facts on this issue, it only went on to have a two an a half hours program to discuss the issue. The City council equally released public statements which they indicated that Mohau was not innocent of all the charges. It even went to an extend of using the City Council newsletter to inform the public that Mohau is not innocent. During the beginning of the trial * Mohau was suspended from his work without doing the suspension officially, but in an attempt to frustrate him all his responsibilities were taken to a newly appointed city council spokesperson * Despite having been promised that his responsibilities will be brought back following the finalization of both the court process and the internal hearing, Mohau continues to be subjected to total frustration without any explanation. It will be noted that this accident took place when the powerful faction * "Local" 1996 class project was in charge and it used the accident as an excuse to deal with Mohau and many others who did not agree with factionalism, that is the reason in our view that Mohau was subjected to this condition as a result of political differences. The fact that some of the disbanded Sub regional leadership of the ANC in Potchefstroom participated in helping the NPA and the police to organize witnesses and evidence which would ensured that Mohau is found guilty, it is a very dangerous fact and reality. Some of the witnesses indicated that they were visited and promised employment only when they give evidence against Mohau * by some leading cadres. These witnesses including their false evidence were lambasted by the magistrate who finally found Mohau not guilty, the magistrate went further to indicate that this accident matter was hijacked by evil politicians for political reasons and aims. Again just before the trial reached its final stage, leading cadres manipulated a certain Community radio and instructed them to report negatively about Mohau and the trial. For instance in more one instance * the radio station lied about Mohau. When the medical doctor gave evidence in court, she indicated that there exist a possibility that Mohau did not drink or used any anything that could have impacted negatively on his driving * the radio station chose to lie and say the Doctor said Mohau was drunk. Secondly, on the 17th of September 2009, after the magistrate dismissed two charges of Drunk and driving and reckless driving, the radio station said Mohau has been found guilty and will be sentenced on Monday, 05 October 2009 * contrary to that report Mohau was found not guilty and yet the radio station chose not to invite Mohau but invited Chris Hartting of the DA to the studio for an interview regarding the Mohau trial. It is in this context that our view regarding the disbandment of the Provincial, Regional and sub regional structures should not avoid the consideration of disbanding some of the municipalities. For instance in Potchefstroom majority of those who are serving in strategic positions in the municipality are part of the disbanded Sub regional structure. The point being that if reasons for the disbandment are due to problems encountered by ANC structures, that must include their corrupt and factional tendencies in relation to the municipality. We have argued that leading people in the municipality used their positions and government resources to advance their factionalist strategies. And therefore by not re-calling them means we are shall never be able to achieve our aim of building a strong ANC.
