Moseneke is a threat

Rosario Brown, Letters, Business Day, 6 September 2011

During the recent "consultation" between the Judicial Service Commission and President Jacob Zuma ’s candidate for the position of chief justice, Justice Mogoeng Mogoeng, it became quite clear that acting Chief Justice Dikgang Moseneke is a bitter, angry and vindictive man.

The question should not be the suitability of Justice Mogoeng, but rather the suitability of Justice Moseneke to serve as our second-most senior judge. The critical question right now is whether Justice Moseneke can be trusted working under Justice Mogoeng or whether he would do everything in his power to undermine our next chief justice. I believe the president did the right thing by not nominating Justice Moseneke as chief justice.

The Constitutional Court should not be a rubber stamp for the ruling party, but it should also not be used as a replacement for Parliament when it comes to making laws. If the courts overturn every major decision made in Parliament, what is the purpose of a Parliament, and polls every five years?
