Dear Cdes,

This matter that is discussed here is important.

I think this is a matter of organize, organize, and organize!!!

These might be learner/employees in terms of the Skills Development Act(SDA)of
1998, s18(2).

They must have 'employment contracts' which are registered with the relevant
Sector Education
and Training Authority (Seta).

When they have a 'contract of employment', it is arguable that they are
employees also and they
may be entitled to join who might accept them as 'associate members' with
limited 'representation
rights' if their constitutions allows it.

And can represent, after organizing, them in disputes with the 'employer' in
the workplace or CCMA
or further.

Or still represent them in disputes as Cosatu has done in Sdumo vs Rustenberg
Platimum Mines, and is
doing now against the Leon Louw's and Franscis Kendall's 'neo-liberal
neo-conservative rabid free
marketeers of the Free Market Foundation's attack against unions and collective
bargaining, as an
interested party even if they are not its members.

WFTU Africa will be dealing with the Skills Development Act and related
matters, particularly disputes,
this coming Sunday at Numsa's VMCC in Newtown from 9 am until 1pm.

We will post the relevant notice in this CU and other available spaces.

Regards
Vuyo 'Doc' Bikitsha

Subject: Re: [CU] Student trainings

Thanks CV

The issue here is the environment where students are working, when workers or
employees are not organized themselves, these students will find them in this
situation.

The employer has a huge responsibility even if there are terms and conditions,
the students will not be able to get their qualifications due to the fact that
they need to get reports of what they were doing besides the papers from the
employers.

The companies with good reputations does not take these students. The question
is why?

What I mean is, I think you should organise the students, themselves

If you are only in the position of voluntary do-gooder, then you can be
embarrassed at some stage.

There may even be a reasonable explanation for this situation. Anyway,
warehouse work is honest work and it teaches you about systems. So long as it
does not go on forever, it may be good experience for anybody.

In general, government can assist an organised people, but if the people are
not organised, it will be very difficult for the government to carry every
single problem. How do you think government will be able to represent every
single worker to every single employer, if the workers themselves are not
organised? It is the same with these students.

Organise them, to speak for themselves, if possible.

I think you need to organise first, before you phone Dr Blade.
