it's OK when I use latest version of aufs.
   kylin@kylin-Inspiron-580s:~$ cat /sys/module/aufs/version
   4.4-20160627
   kylin@kylin-Inspiron-580s:~$ uname -r
   4.4.14
   kylin@kylin-Inspiron-580s:~$ cp new /etc/
   cp: cannot create regular file '/etc/new': Permission denied

   OK, but even for linux-v4.4, aufs4.4 returns the same error code.
