Ok i now found 1 error i wrote TOMCAT_USER instead of TOMCAT5_USER (me stupid)
When I start tomcat it says:
[EMAIL PROTECTED]:~# 1 Previous file handle doesn't exists 
/var/lib/tomcat5/logs/ca                                                        
    talina_2007-07-11.log


but dspace runs!!!

Interesting. A couple of other suggestions:

1) Make sure that the TOMCAT_USER=dspace line is the only such line in
/etc/default/tomcat5

2) Stop and start with:
sudo /etc/init.d/tomcat5 stop
sudo /etc/init.d/tomcat5 start

3) Send us the output of 'ps wuax | grep tomcat5' again
