Do you really think MS will *care*?  Outfits like that care in direct
proportion to the amount of money that might be involved.  If they
thought there was still money in MS-DOS, they never would have
released the source Jack claims to have looked at.  Going after
something like FreeDOS would take far more time and expense than it
would conceivably be worth, and I can't see them bothering.  What
would be in it for them?

It's your project and your call, but I think you're borrowing trouble.
