Kang awang, ada yang sedikit mengganjal:
1. Apa benar adanya raja-raja kecil di daerah telah menyebabkan biaya tinggi
operasi migas sehingga menaikkan cost recovery? Aku koq agak susah
memahaminya. Bagaimana kira-kira back-up data penunjangnya koq sampai
didapatkan kesimpulan seperti itu? Apakah raja-raja kecil beserta aparatnya
itu "memalak" operasi migas di daerah sedemikian rupa sehingga biaya yang
dikeluarkan untuk E&P jadi membengkak cukup signifikan sehingga dijadikan
contoh kambing hitam CR yang naik terus sementara produksi turun terus?
Mohon pencerahan: berapa persen jumlah biaya "pemalakan" oleh raja-raja
kecil tersebut dibandingkan dengan keseluruhan peningkatan ongkos produksi
(dan eksplorasi tentu saja)?
2. "Sebagian operator menunda pemboran sumur2 E&P-nya karena biaya tinggi di
daerah". Apakah secara resmi (dan faktual) memang alasan utama penundaannya
seperti itu? Kalau memang masalahnya seperti itu, nampaknya memang data
penunjang resmi-nya harus segera diungkapkan kepada Menteri ESDM dan Pak
SBY, supaya dengan jelas juga mereka dapat menyodorkan fakta tersebut ke
Gubernur, Bupati, dan Walikota daerah penghasil migas sebagai bagian dari
bahan "teguran", yang notabene juga merugikan daerah penghasil migas
sendiri, karena turunnya produksi dan naiknya CR membuat bagian "BagiHasil"
mereka menjadi berkurang.

Issue baru yang lama.
Produksi turun terus sementara cost recovery naik terus tidak bisa segera
diterima secara hitam putih, banyak sekali hal terkait kepada itu.
Reformasi yang ceritanya diinginkan semua rakyat itu telah membentuk raja2
kecil di daerah yang telah menyebabkan biaya tinggi operasi migas - ini
menaikkan cost recovery, nah itu satu contoh saja faktor yang terkait.
Karena biaya tinggi di daerah, sebagian operator menunda pemboran sumur2
produksi dan eksplorasinya, sumur2 produksi hanya terealisasi 70- 80 %,
sumur2 eksplorasi tak sampai 70 %. Apa akibatnya ? Produksi menurun,
penemuan lapangan baru menurun. Tentu ini tak diberitakan kan ? Tetapi,
orang yang memahami dengan baik industri migas akan tahu duduk perkara
sebenarnya.
Pengurusan persetujuan di BPMIGAS lama sehingga menurunkan produksi
minyak ? He2... lucu membacanya. Proses persetujuan di BPMIGAS juga telah
diaudit oleh lembaga independeden internasional sertifikasi ISO dalam
empat tahun terakhir ini. Dan, BPMIGAS terus mencari cara bagaimana agar
persetujuan terus disederhanakan tanpa mengurangi ketelitian. Di group
saya di BPMIGAS, operasi boleh dijalankan sebelum persetujuan resmi
diberikan, tetapi pekerjaan tersebut harus disetujui dulu secara teknis
dan anggaran. Aturan2 procurement pun terus dibenahi sehingga tak
berbelit2 tetapi tetap menampung azas keadilan.
BPMIGAS memerlukan evaluasi yang hati2 atas usulan2 KPS seperti usulan
sumur2 eksplorasi di blok produksi dan semua usulan POD (plan of
development). Banyak kan kasus POD bila "harus segera disetujui karena
hal2 tertentu yang "politis" (katakanlah begitu) telah berdampak buruk
merugikan negara sebab cadangan yang diajukan ternyata jauh di bawah
kapasitas produksi yang telah terpasang. Saya tak perlu menyebut lapangan2
mana saja di Indonesia yang begitu, tetapi itu telah sangat merugikan
negara.
Evaluasi yang hati2 tak bisa dilakukan dalam waktu cepat tentu, mestinya
semua orang mengerti hal ini. Telah banyak kasus2 merugikan negara akibat
hal ini.
Minyak langka, masyarakat ngantri minyak di mana2. Ini bukan salah BPH
Migas, memang kan pasokan minyak sedang dikurangi agar masyarakat tak
terlalu bergantung lagi ke minyak. Penggantinya adalah gas elpiji. Kalau
gas elpiji pun langka, nah maka itu yang harus dipertanyakan ke BPH Migas
atau Pertamina.
Sebagian masyarakat kita pun kepedulian sosialnya kurang, tengah kedelai
langka dicari, baru2 ini polisi berhasil menemukan gudang ratusan ton
kedelai di Jawa Timur, sengaja ditimbun karena harganya sekarang sedang
meroket. Tak jarang kan masyarakat pedagang berbuat hal serupa untuk
minyak dan gas elpiji ?
Untuk dipahami, jangan sekedar melihat di permukaan.

Indonesian MPs Consider Closing Oil, Gas Regulators Due to Poor
Performance
Text of report in English by influential Indonesian newspaper The
Jakarta Post English-language website on 23 January
The People's Representative Council (DPR) is weighing [up] the
possible closure of upstream oil and gas regulator BPMigas and
downstream regulator BPH Migas due to decaying administrative
performance and failures to meet targets.
The deputy chairman of the DPR Commission VII overseeing energy and
mineral resources, Sutan Batughana, said here Tuesday [22 Jan] the
commission would hold several discussions with oil and gas investors
operating in Indonesia to hear their opinions on the regulators'
performance to determine whether closure was necessary.
"We have received reports that the performance of these two bodies
has worsened, for example, in the process of securing business
permits and we want to verify this with the business actors,"
Batughana said after the first closed meeting with oil and gas
contractors on Tuesday.
"Some have complained the process to secure approval from BP Migas
for budget spending on exploration and exploitation activities (now
takes longer than) when Pertamina controlled the sector, and that
this has hampered our oil production," Batughana, who led the
hearing, said.
He also referred to BP Migas' failure to increase the nation's oil
production despite a sharp increase in recovery costs.
He said the recovery costs repaid by the government to oil block
contractors in recent years had continued to increase despite the
decline in the country's oil production.
Figures from the Energy and Mineral Resources Department show the
amounts being paid out by the government under the cost recovery
system surged from USD 7.63 billion in 2005 to USD 9 billion in 2006,
even though output declined during that period from 1.06 million
barrels per day to 1.04 million barrels per day.
One rumour in circulation holds that after accusations of failing to
do his job, BPMigas chairman, Kardaya Warnika, will be replaced by
the current director of upstream oil and gas development at the
Energy and Mineral Resources Department, Priyono.
Lawmakers also discussed BPH Migas' failures in the distribution of
oil and gas in the downstream sector, particularly kerosene, as it
was now considered scarce in the market.
"We may disband the body if it proves to be failing in guaranteeing
supply for the public, because that's its job," Batughana said.
BPMigas and BPH Migas were formed as independent bodies in charge of
regulating the oil and gas sector under the 2002 Oil and Gas Law,
which liberalised the sector and ended state oil and gas company
Pertamina's monopoly.
The chairman and members of the two bodies are installed by the
president with the consent of the legislative body.
Tuesday's meeting was attended by oil and gas companies Pertamina,
Royal Dutch Shell and UK-based BP. In the next meeting, the
commission will continue the hearing by summoning other oil and gas
companies.
