Well, I'll be first to admit that I am easily confused, perhaps more easily than most:)

However - did you try to install MSDE off sp3a?  I'd be very surprised if you could.

Its still not clear from that what the official right to use policy is though. The 
SP3a download for the MSDE is a full install, and doesn't require license keys either, 
so I really don't know.
