Aires Rodrigues, Goanet member and vocal legal activist has conducted several 
campaigns directly blaming Manohar Parrikar as head of government, for several 
wrongs of commission and omission.

I don't know how successful he has been or whether he has made even a slight 
dent with these màtters but this much I know: he is going to have even less 
success in the future if a recent GOI case is anything to go by.

In the public mind, the authority of last resort, going by the Constitution, is 
the Supreme Court of the country. But in the latest case before it, the Court 
has pleaded helplessness in deference to the Government in the case to which I 
refer below.

GOI asked the court to fast-track criminal cases of pending charges against 
Members of Parliament. Simply put, the Chief Justice denied the request saying 
that fast tracking should not be exclusive to MPs but to other categories of 
cases as well. He observed that long delay of cases was a poor reflection of 
democracy in India (methinks that was stating the obvious).

However, he also commented that there would have to be a change of 
administrative procedures and the need of placing a lot of related 
infrastructure in the smaller jurisdictions of the justice system in rural 
India. So much, so far, is true.

But here's the kicker. Instead of requiring the Government to complete the task 
by a certain period within the parameters set by the court (as for example 
ordering that criminal cases should be brought before the courts within 3 
years), the CJI instead pleaded helplessness to order the govt to do this due 
to the enormousness of the task and the availability of resources. 

This is a laughing matter since it encourages the Government of the day to just 
ignore or dance around the intentions of the courts as has been happening very 
often lately in the country. Now they have a formal remark of India's Chief 
Justice of the Supreme Court to support their inaction.

Now tell me what chance Aires has against the CM even in a case where the 
courts have ruled in the former's favor.

Is my interpretation of the situation correct in assuming that succour from the 
Indian justice system is merely 'touch and go', or do the courts in India 
really hold sway in correcting government wrongs and injustices.

Aires has made quite a number of excellent points in his article. They
are, as follows:

1: Goa’s Public Health care system is in dire straits.
2: Repeated political interference by successive state governments has
been detrimental to Goa’s public health care.
3: GMC should aim at providing all the super specialty facilities so
that patients should no longer have to travel to Belgaum, Bangalore
and Mumbai for medical care that could be provided at Bambolim.
4: Goa Medical College is not a veterinary hospital.
5: Hospitals and health centres can never compromise on cleanliness
and sanitation. Every head of the department should be made
responsible and accountable for the overall state of his unit.
6: Serving in the medical field was supposed to be a mission with a
passion. Unfortunately like most other professions the medical arena
has too become a business venture with one goal. Vitamin 'M' all the
way.

However, he (Aires) has made the classic mistake common to many an
'outside-the-expertise' expert i.e. focus on the penthouse instead of
the foundation.

BTW: There is a distinct difference between Public Health Care
(preventive) and Health Care provided to the public at tertiary
centres; interconnected as they may be. I submit that 'autonomy' in
the field of Preventive Care is an oxymoron. Preventive care, by
necessity, needs Governmental intervention and support (different from
political interference). As it is one of the dynamic areas of health,
it also needs staffing by appropriately qualified, trained and
experienced staff, with the Directors being ALSO well-read, and
well-published physicians who update themselves rigorously and
regularly at the national and international levels.

I do not know why the Vitamin 'M' comment is being reserved only for doctors.

When the whole society (including and especially lawyers) is driven
primarily by Vitamin 'M', why pick only on the doctors. Are they the
only ones who are supposed to be on a 'mission with a passion'? Mark
you, I'd suggest that it would be infinitely better for society as a
whole IF every profession was on a 'mission with a heart' instead of a
'mission with a passion'. Passion, with all its benefits, is also the
conduit for destructive activities such as Vengence and Crime.

Aires adds: 'one has to cough up at times up to 50 lakhs if not more
for a medical seat by way of capitation fee'.

I believe that GMC does not offer seats by way of 'capitation fees'.
Even so, if I was a resident of Goa, I would be more worried IF a sick
patient was expected to pay a 'capitation fee' to certain 'office
staff who may or may not be doctors', just to get admitted into
hospital.

Social activist Advocate Aires Rodrigues has accused Goa's Advocate General
Subodh Kantak of abetting perjury and conniving with Health Minister
Vishwajit Rane to mislead the High Court on the factual position on Sec 506
of IPC. 

In a 21-page affidavit filed before Panjim bench of the Bombay High Court
here yesterday, Mr Rodrigues stated that the Advocate General, being the
principal law officer of the state, ought to have placed the correct facts
before the High Court, even if they were not to the liking of the
government. 

The Advocate General, instead of upholding high moral ethics in the
profession as the leader of the Bar, had chosen to collude with the accused
Minister by not only suppressing material facts from the Court, but also
making suo moto recommendation about withdrawal of criminal cases under Sec
506 of IPC, he alleged. 

In his affidavit, Mr Rodrigues has also submitted that Health Minister
Vishwajit Rane deliberately suppressed a very material fact that the
investigation into the complaint against him was done pursuant to orders
passed by the Judicial Magistrate, First Class at Panaji. 

While the issue of the chargesheet against the Health Minister was before
the High Court, Mr Kantak on May 7 held a closed door meeting with Old Goa
Police Inspector Gurudas Gawade and Public Prosecutor Winnie Coutinho to try
and help the accused Mr Rane on account of his clout as a Minister, Mr
Rodrigues said. 

In a 73-page chargesheet filed by the Old Goa Police, Mr Vishwajit Rane
faces charges under sec 506 (II) of Indian Penal Code, which carries a
punishment of imprisonment of seven years or fine, or both. 

Judicial Magistrate First Class (JMFC) Ms Sharmila Patil has directed Mr
Vishwajit Rane to appear before her on September 14 to answer charges of
having threatened to kill social activist Aires Rodrigues on July 31, 2007.

14 Oct: 2 pm UK time.  I managed to call Aires in the hospital and he
appeared to be in reasonable spirits considering his ordeal.  Evidently
during the attack he fled to the restaurant's  toilet  and managed to lock
himself  in.  The goons thrashed the restaurant before leaving.

I am not surprised at Aires Rodrigues changing his
stances. And I am surprised why others are suprised at
his support of BJP. In his interview to Goa Today, he
has said that the his Goa Bachao Andolyan (GBA) cannot
remain political.
Lot of secular-minded Goans would not want BJP back in
power, however good it claims to be and however good
is may have been during its short reign. The saffron
colour and ardi charddi do not fit into the Goan
secular environment. 
In Aries's about turn, the GBA should learn a lesson,
though I am surprised why they encouraged such a
person in the first place. Goa Today's Managing Editor
Vinayak Naik has called him ever so dynamic.
Probably an untrustworthy dynamo would have seemed
apt.
May his tribe increase.

Prominent GBA activists join political camps


Even as the Goa Bachao Abhiyan convenor, Dr Oscar Rebello maintains that the 
GBA is apolitical, some of its prominent activists have joined the political 
campaigns. While some of the activists in South Goa including noted 
tiatrists, Wilmix Mazzarelo and Prince Jacob have joined the Churchill camp, 
some in the North Goa, including Mr Aires Rodgriues are now in the Bharatiya 
Janata Party camp.

Another group of activists including former MPT chairman, Mr Arvind Bhatikar 
has been campaigning against the BJP and some viciously corrupt sitting 
MLAs of the Congress party.

Mr Aires Rodrigues, addressing a press conference, this morning said that 
the people of Goa have to give the BJP a clear mandate at the forthcoming 
assembly polls to ensure that the state is steered out of the current rut of 
rampant corruption and administrative chaos.

Informing that he would actively campaign for the BJP during next 13 days, 
Mr Rodrigues informed that he has written letters to the state BJP chief, Mr 
Shripad Naik and the leader of the opposition, Mr Manohar Parrikar 
suggesting that they should give priority to issues like reducing the 
retirement age of the government servants from 60 to 58, introducing 
transparency in recruitment in government services and tackling garbage 
disposal issue, if the BJP comes to power in the state.

Mr Rodrigues also condemned the habit of the Congress leaders of converting 
politics into business venture and rushing to the central observers before 
taking any decision pertaining to the welfare of Goa.

Meanwhile, Wilmix Mazzarelo told 'The Navhind Times' that the group of 
tiatrists - some of them having different political ideologies - has decided 
to support the Save Goa Front on the single issue of providing the status of 
the state language to Konkani in Roman script.

Mr Churchill Alemao has given us this assurance in the manifesto of SGF and 
our hope lies in the party, he added.

Ms Patricia Pinto of the Goa Bachao Abhiyan, on the other hand reacting to 
the political affiliations of various factions linked to the GBA said that 
these different organisations are not bounded to the Abhiyan and are free to 
express their political preferences.

These organisations came under the GBA umbrella with an honest objective to 
oppose the Regional Plan 2011 and were committed to take this objective to 
its logical conclusion.

However, the core members of the Abhiyan like myself, Dr Oscar Rebello, Ms 
Sabina Martins and so on would continue to follow the apolitical approach of 
the GBA, she added.

Dear Frederick,
If I recall correctly the priest in that particular
Ribander case was vindicated, and unfortunately it was
not one of Aires' shinning moments. I am only
peripherally aware of Aires' many accomplishments but
like all activists, he's vulnerable and will
invariably and inadvertently back horses that aren't
going to win or have a nail in their hooves to begin
with.

It is ofcourse a telling state of our democracy that
so much activism by the common man is required to keep
our polity in check. The mark of a functioning
democracy is that such work is done by the elected
representatives themselves.

[Goanet] Aires Rodrigues arrested?

Folks,
I received the following today:

PANJIM, Jan 4: Save Goa Front Convenor Aires Rodrigues
was today restrained from attending the proceedings of
the second day of the Global Goans Convention.
Anticipating that Aires Rodrigues would raise the
issue of the Goa Regional Plan 2011, Commissioner of
NRI Eduardo Faleiro directed the Director of NRI
affairs Ulhas Kamat to summon the police and arrest
Adv. Rodrigues.

A police posse headed by Sub-Divisional Police Officer
Deu Banaulikar rushed to Cidade de Goa, the venue of
the Convention and requested Adv. Rodrigues who was a
registered delegate to leave the venue. Banaulikar
directed the organizers to refund to Adv. Rodrigues Rs
1000 paid by him as delegate fee. On receipt of the
amount Adv. Rodrigues left the venue escorted by the
police.

Meanwhile, Aires Rodrigues has stated that Eduardo
Faleiro’s highhanded dictatorial behavior today has
shown clear signs of insanity setting on the
Commissioner of NRI affairs. Rodrigues has further
stated that any issue that affects Goa is a matter of
concern to all including the Non Resident Goans and
that Faleiro could not highjack the agenda of a
Convention being hosted at tax payer’s expense. It may
be recalled that some delegates walked out of the
convention yesterday in protest against Eduardo
Faleiro’s decision not to allow any discussion on the
Regional plan.

If the above is true, Commissioner of NRI Eduardo
Faleiro is turning out to be a commissioner more
suited for Bihar than Goa!

I am curious if anyone attending the meet is
interested in following up and reporting if the above
is true.

I am also interested in knowing if the office of the
commissioner has a list of projects that need foreign
partners/financing.
