Personally, I wouldn't go so far as to say the radio performs correctly. Without writing a long history, let's just say that I discovered this RF gain issue 8 or 9 years ago.  I demonstrated it to an Elecraft engineer in my shack who had brought along his fully up to date K3 which we compared.
