please forget this, It was an illusion. The system was running parted 
version 1.6.22 somehow.

As for now it is using this version, so the CVS is working.

My findings on this were:

there are differences on the output for parted 1.6.22 and 1.8.8 but both 
  call parted in the same way (in my case):


parted -s /dev/dsk -- mkpart primary fat32 0 -0
parted -s /dev/dsk -- mkpart primary fat32 0 4000


for some reason they are called twice.

on the 1.6.22 version there is a complain about an obsolete API used. I 
had test the patch provide on bug 1494470. But still the same problem 
after the initial installation: NTLDRNotFound

any thoughts?
