I don't think it is tolerated, but rather not policed.  It is the same 
in South-Africa.  They won't come door to door to see if you have 
counterfeit media, but if someone complains or reports you, you could be 
arrested.

It is an offence similar to speeding.  It would be naive to think that 
if you are speeding, and not caught that it is tolerated and you are safe.

WMV codecs are MS's way of countering codec claims against them.  It is 
not a very good broadcast codec, but is good enough for home users.  
Rather use the ogv codec.
