Shona, I have had quite a few cases where the Hon'ble High Court asked the petitioners to withdraw the writs since they did not explore the institution created under the Disability Law i.e. the CCPD/ State Commissioner- Disabilities.
Also it is advisable to have the order from the CCPD/State Commissioner. If that doesn't work, then you have a stronger case in the High Court since you are armed with a judicial order that has been passed by a court of competent jurisdiction. This is not to discourage you as many courts have accepted the petitions too in absence of any opposition from the respondents.
