Well NY wants more broadband deployment so there's been a lot of involvement from NY DPS lately.  They're trying to remove barriers to broadband roll out, and the topic you brought up is an area where some things have changed.

 * If the pole is otherwise fine but doesn't have room for us with
   appropriate clearances, then it's our expense to make room.
 * If there are existing violations for comm clearances or MAD, then
   the pole owner now has to pay for it.  I mean maybe they were
   supposed to pay for it before, but now they really do.  NY came down
   hard on this stuff.

I'm not sure if you saw on the news about NY kicking Spectrum out of NY State.  They're not really going to force Spectrum out, they're just proving they can if they want to.  That and a few other incidents were (at least I'm pretty sure) demonstrations of how the state can make life hard for utilities who don't want to toe the line.  I could name a few /downsides /to heavy state involvement, but the upside is that everyone's attitude about pole attachment has improved in the past year or so.

Benefits of living under the thumb of the Evil Empire I suppose.
