As the Copyright Office discussion indicates, always attempt to get the authors permission. If this is not possible, then be sure that it is used for the purposes noted (and no other) and that the four conditions specified are met.
Fair Use is a swamp in which both authors and users almost always get bogged down. So users need to do their best to ensure that they are using the material for the purposes and in the manner allowed under the exclusion.
