Acually, SUN has one of the worst JVMs available, and that's probably a big part of what's got Oracle upset about Android. (That and the money, of course.)
I would assume that Google got one of the standard development licenses from Sun, where they could do pretty much whatever they wanted -- it just had to pass the JCK tests if they used the name "Java".
