I believe from the very beginning it was stated publicly that it was for apps that had not previously been published. I was fearing that they would not allow the entered apps to be published until after ADC2, so the fact that they are allowing them to be published even before ADC2 begins is good to hear. Of course obviously Google don't want to keep all these great apps out of the market any longer than they need to.
Whatever date they announced the official rules, there will always be people who published their app a day, a week, a month, or a year prior, and who want their shot at the prize. It may be unfortunate timing for you, but I think there is nothing "unfair" about it.
