Timothy is quite correct.
In fact, the original rules said that you couldn't have published your app
publicly anywhere at all, but we loosened that rule in response to feedback
since it unintentionally excluded open source projects.  We also were
originally going to require apps to wait until the end of the Challenge
judging before publishing to Market, but we reconsidered that as well (and
changed it to 1 August) since as Timothy mentioned we don't want to keep
apps out of the Market needlessly.  But in the end we had to pick an
eligibility date, which was always guaranteed to cut off at least some
developers.

The goal of the ADC2 is to encourage developers to build new apps for the
Market, so we picked the rules and deadlines to best encourage that, while
balancing interests to keep things fair.
