Yes, I agree that google should encourage and support open source.

I personally think the rule should be along the lines that an existing
apk would be eligible if significantly improvement is made, but ADC1
winner (not participant) would be excluded.

Btw, we are also trying to support good open source software, not
trying to rip anyone off.
Open source software always carry the risk of being ripped off,
whether the developer knows or not. I have seen too many of these
problems in China and can't do a thing about it. Rumour has it that MS
do the same ;)
