It's just been brought to my attention that someone totally unrelated to AndAppStore has uploaded the client to Android Market under the label "File Manager" (http://www.cyrket.com/package/com.andappstore.androidclient), which is (correctly imho) being slated as it isn't a file manager. We allow free inclusion in ports, but we retain copyright over it to ensure that we can stop developers doing stupid things with it (e.g. uploading it to Market claiming it's a file manager).
Now here is my problem; We are not a US based entity, did not download it to the US, we're not using equipment or services purchased from the US, and the developer who has uploaded the app would appear to not be US based either, and yet the only method provided by Google for removal of infringing content is a DMCA notice, which is a US only law. We have no wish to pay out to engage the services US attorney to explore the intricacies of the DMCA and accept Googles forced T&Cs where we would cover their US attorneys costs if the DMCA takedown was unsuccessful just to stop a clear infringement of our copyright under UK law. So, we're going to get in contact with Google UK to start, but does anyone have any other suggestions on how to ensure that our copyright is upheld without needing to go through the US legal system.
