Define "legitimately". That is not the right word for this as any phone that has root *HAS ROOT* and is therefore 'legitimate', i.e., not a fraud. To buy an illegitimately rooted phone is to buy one where the seller LIED about it being rooted.
ADP1 is the only (common) device SHIPPED WITH ROOT. Others require modification, but that doesn't make them illegitimate. There are other devices besides ADP1 that ship with root, Openmoko is another, and yes, android runs on it. It is SO open that it virtually can't be not rooted.
