We have had conversations on this list on this topic before, though
Apple's terms were much worse then.

There is still Cydia (an alternative appstore for jailbroken phones),
and there is still the possibility that someone with an iOS developer
setup may wish to compile it themselves. The appstore terms have
improved considerably since the last time the topic was raised,
perhaps they may become suitable, in time.
