In fact, although Congress has considered antispam legislation from time
to time, no such law has ever been passed. Any statement that the email
complies with US law is a flat-out lie.
Some states--Washington, Virginia, and California--do have some antispam
legislation. California allows ISP's which receive spam to attempt to
collect a fee from the spammer. Washington allows an individual whose
email address is registered in a statewide database of state residents to
sue the spammer. (I think that's on hold right now pending a court
challenge.) Don't know what Virginia's policy is.
