I doubt that people that have got shot are winners.

Back to the topic, as with many other things the law isn't able to keep up.
And who should be prosecuted? All the people that, despite the fact that
they should be knwoing better, are using Outlook? If so if someone hacks
into a computer (often a server) and uses it to attack another target the
person/organization owning the hacked computer would also be convicted.
They could also have fixed any security bugs.
