I'd be very much in favor of that. The first step is to order the sections so that XHTML comes first. I have suggested this before. This is very close to editorial, but can already give some hint.
The second is to add a sentence such as this: "Content producers that can produce both XHTML content and HTML content SHOULD produce XHTML content."
