Keep in mind Apple's m4p encoding is most certainly not new. And m4p is not even an encoding, either. It's a standard mp4 container file rapped in a drm. But this was used pre2009 with itunes purchases. The same restrictions were placed on the files, with some exceptions.
1. They didn't expire, of course.
2. You could burn them to a cd and rip it, to get some drm free versions, but they were recompressed versions so they would be downsampled.
