Dark has contacted them (and Capcom); Nintendo and Capcom appear to be the two biggest game companies least interested in accessibility (some Capcom titles are reasonably playable in spite of this; see Stereo and screen announcements in Street Fighter).
In addition, Hatred contacted Nintendo when he wanted to make an accessible Pokemon game, and the response as I understood it was something like, "We receive more requests than we can reasonably investigate, so we default to 'no' for all of them. This does not mean you would not be protected under fair use, but you'll have to find and ask IP lawyers on your own, and we really don't want to deal with it so please just shshsh".
Which I'm interpreting as "Ask us no questions, and we'll tell you no lies."
Which I'm sub-interpreting as "So long as we don't hear about it, you won't have to worry about contesting a DMCA takedown notice, which you may or m
ay not win. So Shshshsh."
I still encourage people to get a legal copy of the games in question anyway, just so it cannot be said that this hurts the companies in any way. But realistically, they aren't suffering any damages when a demographic excluded from their releases plays something extremely similar for free, so the only question is whether or not their regular audience will be affected. It emphatically is not.
